Christine McCarthy

I am a nationally accredited mediator through Resolution Institute, and on the Panel of Mediators with the Victorian Civil and Administrative Tribunal (VCAT).

I have retired from the position of Ombudsman at the Australian Financial Complaints Authority (AFCA), where I determined and mediated insurance disputes in the superannuation, banking, financial services and insurance markets since 2007. Because of this role, I bring to mediation the perspective of a decision maker.

While Senior Legal Counsel at Worksafe, I was part of a small team managing all Worksafe’s litigation. I attended many court-ordered mediations, settlement conferences and Judicial Settlement Conferences and have a deep understanding of what a client needs from mediation.

Before joining Worksafe, I was a partner at Cornwall Stodart lawyers, specialising in insurance law and other commercial litigation. My clients included Worksafe, the TAC, and other national general insurers and reinsurers. As a litigator with several decades’ experience, I strongly believe mediation or alternative dispute resolution is cheaper, quicker and more effective than court litigation.

I bring to mediation substantial experience in litigation, common sense, and a preparedness to listen in helping parties find the best solution to their dispute.

I am a University of Melbourne graduate with a Master of Law, specialising in insurance law, torts law and alternative dispute resolution.
